Chifeng Shuotong Foreign Language Art Specialized School is a private school, English being our main specialization. We employ a foreign teacher with the idea that he/she will improve our students listening and speaking abilities.

School situation

1.Our classes are an extra curricular activity for students and have no relation to their state schooling. Thus all classes are arranged according to students’ spare time。Evenings and weekends as well as holidays are our usual times of operation.

2.Chinese and foreign teachers cooperate with each other in the teaching of their related classes. A Chinese teacher teaches one class 12 or 15 class hours a month. A foreign teacher teaches a class 1 or 4 hours a month. At present the school has twenty different classes.

3. The Foreign teacher’s work load is 22-25 class hours (every class hour is 50 minutes ) every week, the monthly work load is 88 class hours .

Job remuneration

1.Monthly salary of 5500 RMB.

2.If the school fails to arrange a total of 88 hours monthly the monthly salary remains the same.

3.We offer medium-sized standard accommodation located in our school. Included is a TV, computer (internet), shower, bathroom, western toilet office furniture, etc…

Foreign teacher requirements,

1. The foreign teacher must be healthy, aged 55 years and under.

2. We require North American native English speakers with pure untainted accent.

3. We require the foreign teacher to hold the following; bachelor's degree, teaching credentials and teaching experience.

4. The foreign teacher is expected to observe Chinese law, perform his or her duties to the best of his/her abilities with accordance to the signed agreement.

5. The foreign teacher is able to work for one year.

CONTRACT
Party A:ChiFeng ShuoTong Foreign Language And Art Specialized School.
Party B:

This contract is made in spirit of friendly cooperation by and between Party A and Party B, whereby Party A shall invite Party B for service as foreign staff member teacher on the terms and conditions stipulated as follows.

I. Term of Employment

Party A appoints Party B to be an English teacher. The period of service will be from Feb. 2005 to Feb. , 2006.

II. Duties of Party A

1. Party A shall introduce Party B to the laws, decrees and relevant regulations enacted by the Chinese government, Party A’s work system and regulations concerning administration for foreign teachers, and cooperate with Party B.

2. Party A shall provide free accommodation to Party B, according to mid level standards in Chifeng city. Included a computer (Internet), TV, bathroom, western style toilet, shower, office stationery, furniture and other facilities in the room.

3. Party A shall provide Party B with means of transport when needed for teaching duties.

4. Party A shall bear the cost of the sleeper train ticket for Party B once to Chifeng, upon the expiration of contract, Party A shall bear the cost of the sleeper train ticket for Party B’s return.

5. When Party B begins teaching duties in Chifeng ShuoTong school, Party A shall buy life insurance for Party B.( insurance amount is RMB 100,000)

6. Party B shall provide Party B’s visa free of charge in Chifeng.

III. Duties signed to Party B

1. Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government.

2. Party B shall observe Party A’s work system and regulations concerning administration of foreign teachers and shall accept Party A’s arrangement, direction, supervision and evaluation in regard to his work. Without Party A’s consent, Party B shall not render services elsewhere or hold concurrently any post unrelated to the work agreed on with Party A.

3. According to Party A’s teaching arrangement, Party B shall prepare lessons, teach classes conscientiously, and complete the tasks agreed on schedule and guarantee the quality of his/her work.

4. Party B shall join English teaching and research activities organized by Party A 2 class hours to 4 class hours every month.

IV. Party B working tasks and remuneration.

1. Party B shall teach according to Party A’s teaching plans and assignments. (prepare lessons ,teach lessons ,assess students’ work).

2. Work according to the time-table provided by Party A from Tuesday to Sunday each week. Monday is Party B’s day off. In case of special circumstances, holidays etc…, party B’s day off may be changed to a day arranged by both parties concerned.

3. Party B’s working hours are 88 class hours a month, (50 minutes a class hour) 22 class hours a week.

4. Party B’s monthly salary will be 5500 RMB.

5. Party A shall pay Party B’s monthly salary on _______ every month. If Party A doesn’t arrange lessons and Party B’s monthly working hours are less than 88 class hours, Party A is still required to pay Party B’s salary of 5500 RMB. If Party B’s monthly working hours are more than 88 class hours (Party A is obliged to obtain Party B’s consent), the overtime in such cases will be calculated at 80 Yuan RMB per class hour.

6. If Party B is unable to have classes due to business or illness, Party B should discuss with Party A and make up missed lessons, otherwise Party A will deduct from Party B’s monthly salary according to missed class hours at a rate of 80 RMB per class hour.

V. Liabilities in cases of breach of contract.

1. During employment, party A can not dismiss Party B without any reasons, otherwise Party A must pay a breach penalty of 30% of the salary from the date of breach of agreement to the date of termination of the contract to Party B.

2. During employment, party B can not resign without any reasons , in such a case, Party B must pay a breach penalty of 30% of the salary from the date of breach of agreement to the date of termination of the contract to Party A.

3. If Party B fails to teach classes according to the specifications in III Duties assigned to Party B, Party A has the right to terminate the contract.

4. If owing to poor health and Party B can not resume normal work ( provided a doctor’s diagnosis of Chifeng City Hospital), Party B will not bear the liability for breach of agreement.

5. This contract takes effect on the date signed by both parties and will automatically expire a year from the date signed with an option to renew.

VI. This contract is written both in Chinese and English, both texts being equally authentic.
