Brief introduction

Situated in Songjiang District, 45 minutes by bus to the downtown area of Shanghai, Foreign Language High School affiliated to Shanghai Teacher’s University is a full-time boarding school specializing in foreign language education as well as its art and computer education. Also the school offers a complete curriculum of regular academic subjects required of all other schools of secondary education. Covering an area of 660,000 square metres, the school boasts not only perfect teaching and living facilities, but also good physical facilities. Now there are more than 2,000 students aged from 12 to 18 studying in 52 classes at different grade levels.

Since its establishment, our school has always spread the idea of being a Chinese, who are open and aboveboard, being a citizen of Shanghai with “Seven-no” virtues, being a student with such virtues as unity, discipline, diligence and respect for oneself. Over the past decades, our school has been ranked as a “Garden Unit”, one of the most beautiful campuses of Shanghai, and “Civilized Unit” of Songjiang District. In addition, a lot of students have gained many prizes in all kinds of competitions.

Our school offers two foreign language programs, English and French.The faculty of each foreign language program is joined by native speakers. Since 1997, more than 20 foreign teachers have worked in our school, and they all enjoyed their staying and working here. Furthermore, we have established exchange programs with several schools in Australia, the United States and France. So far, the annual exchange programs of mutual visits have provided over 200 students and teachers with opportunities to study abroad.

Our school provides foreign teachers with monthly salary, free meals and free accommodation, including an air-conditioned single apartment with bathing equipment, television, telephone, internet access, and a two-person-shared sitting room and kitchen with a complete kit of kitchen appliances. Usually, a foreign teacher works 16 hours every week --- 40 minutes per lesson, including some outdoor English activities, such as English corner (30 minutes, every Wednesday and Thursday noon). And we will pay RMB75 for each extra lesson.

CONTRACT

I. Party A: Foreign Language Middle School Affiliated to shanghai Teachers University wishes to engage the service of Party B _ . The two parties, in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfil conscientiously all the obligations stipulated in it.

II. The period of service will be from the First day of September, 2005 to the 30th day of June, 2006.

III. The duties of Party B ( see attached pages )

IV. Party B’s monthly salary will be ￥ 5000 RMB(after tax-paid). Free accommodation is offered by Party A (free meals will be included).

V. Party B should give 16-hour-oral-English classes per week and take part in outdoor oral English activities in addition, such as English corner.

VI. Party B will be paid ten months’ salary for his/her one-year teaching and will be given one more monthly salary as a reward for his/her persistence in work while five months’ salary will be paid for Party B’s half-a-year work. If Party B continues his/her teaching for the second year, one more monthly salary for the summer vacation will be added.

VII. Party A will offer ￥ 2200 RMB to Party B as travelling fees on the condition that Party B fulfills its one-year service. Party B can take part in the short-distance travelling organized by Party A, and Party B will enjoy the same special treatment as the other teachers do.

VIII. Party A shall bear the fees of telephone and internet installment while Party B shall bear his/her own phone call fees and online service fees.

IX. After Party B’s one-year service, the additional rewarding salary will be given, provided that Party B has paid off his/her phone call fees and online service fees.

X. After one-year service, Party B will receive two-way non-stop airline tickets from Party A. For the 6-month service, Party B will receive single non-stop airline ticket from Party A.

XI. Party A’s obligations

1. Party A shall introduce to Party B the laws, decrees and relevant regulations enacted by the Chinese government, the Party A’s work system and regulations concerning administration of foreign experts. Party A shall pay for Party B’s physical examination and expert certificate.

2. Party A shall conduct direction, supervision and evaluation of Party A’s work.

3. Party A shall provide Party B necessary working and living conditions ( an air-conditioned single apartment with complete electrical apparatus, such as bathing equipment, television, telephone; a two-person-shared sitting room and kitchen with a complete kit of kitchen appliances.

4. Party A shall provide co-workers.

5. Party A shall pay Party B’s salary regularly by the month ( pay day: the 10th ).

6. Party A will offer the same healthy insurance as the other teachers to party B.

XII. Party B’s obligations

1. Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and shall not interfere in China’s internal affairs.

2. Party B shall observe Party A’s working system and regulations concerning administration of foreign experts and shall accept Party A’s arrangement, direction, supervision and evaluation in regard to his/her work. Without Party A’s consent, Party B shall not render service elsewhere or hold concurrently any post unrelated to the work agreed on with Party A.

3. Party B shall complete the tasks agreed on on schedule and guarantee the quality of work.

4. Party B shall respect China’s religious policy, and shall not conduct religious activities incompatible with the status of an expert.

5. Party B shall respect the Chinese people’s moral standards and customs.

XIII. Revision, Cancellation and Termination of the Contract

1. Both parties should abide by the contract and should refrain from revising, canceling, or terminating the contract without mutual consent.

2. The contract can be revised, canceled, or terminated with mutual consent. Before both parties have reached an agreement, the contract should be strictly observed.

3. Party A has the right to cancel the contract with a written notice to Party B under the following conditions:

(1) Party B does not fulfil the contract or does not fulfil the contract obligations according to the terms stipulated, and has failed to amend after Party A has pointed it out.

(2) According to the doctor’s diagnosis, Party B cannot resume normal work after a continued 30 day sick leave.

4. Party B has the right to cancel the contract with a written notice to Party A under the following conditions:

(1) Party A has not provided Party B with necessary working and living conditions as stipulated in the contract.

(2) Party A has not paid Party B as scheduled.

XIV. Breach Penalty

When either of the two parties fails to fulfill the contract or fails to fulfill the contract obligations according to the terms stipulated, that is, breaks the contract, it must pay a breach penalty of US $ 1,000 (or the equivalent in RMB).

If Party B asks to cancel the contract due to events beyond control, it should produce certifications by the department concerned, obtain Party A’s consent, and pay its own return expenses; if Party B cancels the contract without valid reason, it should pay its own return expenses and pay a breach penalty to Party A.

If Party A asks to cancel the contract due to events beyond control, with the consent of Party B, it should pay Party B’s return expenses; if Party A cancels the contract without valid reason, it should pay Party B’s return expenses and pay a breach penalty to Party B.

XV. The appendix of this contract is an inseparable part of the contract and has equal effect.

XVI. This contract takes effect on the date signed by both parties and will automatically expire when the contract ends. If either of the two parties asks for a new contract, it should forward its request to another party 90 days prior to the expiration of the contract, and sign the new contract with mutual consent.

Party B shall bear all expenses incurred when staying on after the contract expires.

XVII. Arbitration

The two parties shall consult with each other and mediate any dispute which may arise about the contract. If all attempts fail, the two parties can appeal to the organization of arbitration for foreign experts affairs in the State Bureau of Foreign Experts and ask for a final arbitration.

Party B’s Obligations

I. According to the teaching aims and contents stipulated by Party A, Party B shall have 24 periods of lessons weekly ( small class).

II. Party B shall fulfill the requirements of Party A to test and check students’ study on time.

III. Party B shall take part in the weekly English corner and attend meetings organized by the English teaching and research group.

IV. If Party A requires an extra number of teaching contents of Party B to meet the needs of teaching and if Party B agrees, Party A shall pay Party B extra money. The sum of money shall be same as the other teachers’.

V. Party B shall finish his/her teaching tasks according to Party A’s conventional teaching regulations. And Party B shall accept reasonable arrangements like the shift of lessons.
